India's High Court Decision
Another fantastic breakthrough for the millions of LGBT community in India, the world's largest democracy. The petition to the Indian High Court was successful because criminalising homosexual acts was found to be discriminatory and inconsistent with India's constitutional guarantee of freedom and justice for all.
Yes Andy, Ghana's Supreme Court also has the authority to strike down laws that conflict with Ghana's constitution, the supreme legal foundation of Ghana.

This Indian High Court judgment is the first major step towards equality. The law against homosexual acts (Section 377 of the Criminal Code) was enacted by the British in 1860, and continued to exist in the law books of independent India long after it was removed from those of England.
“This law has caused the blackmail, harassment, fear and death of many lesbian, gay, bisexual and transgender (LGBT) people in India. The judgment that decriminalises adult consensual same-sex sexual activity is one of the positive steps that have been taken towards affirming the rights of LGBT persons in India,” Ms. Gopalan said.
Anand Grover of Voices Against 377 – a coalition of groups and individuals working on a wide range of issues, including same sex desiring and transgender people – said the judgment was a crucial step in the struggle towards affirming the rights of all citizens and hoped that it would be aptly executed with the support of the government, police departments and other courts.
“We commend this victory for freedom, dignity, respect and rights of all human beings. This historic judgment is just the beginning, and the struggle for rights will continue,” he said. The UNAIDS has also welcomed the “historic” decision by the Delhi High Court to annul the discriminatory law.

WHY SHOULD HOMOSEXUALITY BE A CRIME UNDER GHANA LAW?
Interestinly, India has just removed the British colonial law regarding homosexuality. Gay sex is now decriminalised in India.
i think this shows it can be done but the key was about 9 years of work to change the law. This is what is absent in Ghana!

Ghana's Recognition of its Diversity and Human Rights of Minorities
The Commonwealth ought to prepare a road map for Commonwealth countries on how they can improve the human rights of their persecuted minorties. The focus of the study should be how Commonwealth Countries have enhanced the human rights over the past 10 years of their citizens who have are gay, lesbians or transgender. Such a study is likely to reveal real progress in Commonwealth countries such as India where change has occurred in the law due to a supreme court ruling that struck down a discriminatory criminal law that was used to blackmail its citizens who happened to be gay or lesbian. The road map may suggest Commonwealth support to fund similar legal challenges in the supreme or high courts of other Commonwealth Countries where oppressive, discriminatory criminal laws remain on the statute books. An alternative roadmap strategy would be the showcasing of model laws in force in Commonwealth countries that have removed all forms of discrimination and introduced legal recognition of the same rights to their citizens regardless of their sexual orientation. Final the Commonwealth ought to provide a human rights track record of each Commonwealth country over the past 10 years in relation to the improvement of human rights and where they stand now. A league table should be prepared ranking the best record to the worst. The table should be a focus point for legislators and be published again 5 years later to monitor progress made. The table should also serve as a basis for ethical investors who wish to reward Commonwealth countries that have done the right thing in terms of basic human rights to their citizens.
