I think the suggestion of Nookn (see thread below) about a petition to the Surpreme Court to demand Human Right Law Reforms in Ghana is interesting. But maybe first we schould investigate (someone with an understanding if Law) if the Supreme Court in Ghana has the authority to order Government law reforms. Maybe one of our members can do some research on this and report back here?

The ambit of Ghana's criminal Code 1960- Chapter 6, Sexual Offences Article 105, is to criminalize and prevent homosexual associations - sodomy in particular, extends to any sexual union involving penile insertion. Thus even consensual heterosexual acts such as fellatio and digital penetration may be a punishable offense under this law. This code havent been revised since 1960,which is the 20th century,49 years ago.
So i ask myself,is Ghana not ready to move forward? The Human right code in Ghana protects every citizen no matter his or her colour,gender,race and political view but doesnt include sexuality. its about time Ghana realise that sexuality is Human rights too. i will start a new article since here doesnt give me enough space to continue so after reading this,go to my treads and continue. thankx.

Another fantastic breakthrough for the millions of LGBT community in India, the world's largest democracy. The petition to the Indian High Court was successful because criminalising homosexual acts was found to be discriminatory and inconsistent with India's constitutional guarantee of freedom and justice for all.

Yes Andy, Ghana's Supreme Court also has the authority to strike down laws that conflict with Ghana's constitution, the supreme legal foundation of Ghana.

This Indian High Court judgment is the first major step towards equality. The law against homosexual acts (Section 377 of the Criminal Code) was enacted by the British in 1860, and continued to exist in the law books of independent India long after it was removed from those of England.

“This law has caused the blackmail, harassment, fear and death of many lesbian, gay, bisexual and transgender (LGBT) people in India. The judgment that decriminalises adult consensual same-sex sexual activity is one of the positive steps that have been taken towards affirming the rights of LGBT persons in India,” Ms. Gopalan said.

Anand Grover of Voices Against 377 – a coalition of groups and individuals working on a wide range of issues, including same sex desiring and transgender people – said the judgment was a crucial step in the struggle towards affirming the rights of all citizens and hoped that it would be aptly executed with the support of the government, police departments and other courts.

“We commend this victory for freedom, dignity, respect and rights of all human beings. This historic judgment is just the beginning, and the struggle for rights will continue,” he said. The UNAIDS has also welcomed the “historic” decision by the Delhi High Court to annul the discriminatory law.

I was inspired by the victory by a GLBT group in Nepal in their Dupreme Court. Could a similar request be lodged with Ghana's Highest Court? Article below.

The Nepali Supreme Court released a decision today granting protections and rights for sexual and gender minorities. The decision comes after four gay rights groups, including the Blue Diamond Society, filed a petition through the court.

According to UK Gay News, the decision states:

– In relation to this matter, directive order has been issued to the Government of Nepal to enact new laws and amend all existing discriminatory laws so that all individuals with different sexual orientations and gender identities can exercise equal rights like any other citizens of Nepal.
– A seven-member committee to be formed by the government of Nepal to study the different same sex partnership/marriage bill/act in other countries and recommend the government to make same sex marriage/partnership act. Based on the recommendation of this committee, the government must introduce a same sex partnership/marriage act.
– The decision also addressed “cross dressing saying can’t be taken as “pollution” but should be taken as individual’s freedom of expression.
– All LGBTI must be defined as “natural persons” and their physical growth as well as sexual orientation, gender identity, expression are all part of natural growing process. Thus equal rights, identity and expression must be ensured regardless of their sex at birth.

Sunil Babu Pant, the nation’s only openly gay member of parliament and head of the Blue Diamond Society, celebrated the decision.

“Reading this decision my eyes were filled with tears and I felt we are the most proud LGBTI citizens of Nepal in the world,” Pant said. “It is the most beautiful news.”
